Biography

James Ferguson is a Senior Associate within Coleman Greig’s Litigation & Disputes Resolution team.

James regularly advises a wide range of clients – such as companies, individuals, insolvency practitioners, strata managers and government agencies. He understands the commercial realities facing many businesses. His pragmatic approach to all matters, helps to achieve successful commercial outcomes for his clients.

James believes that the key to a strong lawyer/client relationship is the ability to communicate effectively, and above all – openly, throughout all stages of a matter. This ability is not only something that he both actively focuses and prides himself on – but that has driven him to follow the path of Litigation & Dispute Resolution.

James boasts a well-earned reputation for both accuracy and efficiency across all aspects of his work. He has previously spent time working within Barristers’ chambers.

He has a thorough understanding of Court processes and uses this experience and understanding to guide his clients with a clear strategy in place.

Alongside his professional achievements, James is a keen Wallabies supporter and loves all things Western Sydney.

  • Acting for franchisors in disputes with franchisees, including Supreme Court of NSW proceedings against master franchise rights holder in relation to breaches of franchise agreement, recovery of royalties and loss of profit claims.
  • Advising and acting for a franchise group in collective bargaining negotiations with a master franchisor.
  • Advising and acting for State Government departments in relation to enforcement of contracts, recovery of debts, possession of land, and causes of action.
  • Acting for machinery manufacturer in cross-jurisdiction dispute relating to product defects and allegations of misrepresentation, including favourable outcome via court-annexed mediation.
  • Successfully recovering debts for corporations and individuals via legal proceedings in State and Federal jurisdiction, including recovery of legal costs.
  • Advising and acting for liquidators in claims against former directors and in recovery of preferential payments under the Corporations Act.
  • Advising and acting for bankruptcy trustees in relation to recovery of voidable transactions.
  • Appearing in mediations, informal settlement conferences and court-annexed mediations (with and without Counsel).
  • Appearing and advocating in State and Federal Courts.
