Sometimes proving innocence is difficult and consuming. Our client was faced with $18 million plus in income tax assessments. We were involved with objections, appeals, debt recovery management, garnishees and a range of other aggressive tactics. After much effort, the result was a withdrawal of all tax assessments together.

We guided a client's NSW compulsory acquisition of their commercial leasehold and then provided substantial tax planning dealing not only with CGT but also depreciation add-back, early asset write off, income versus capital issues and tax effective extraction of the financial benefit.

In a tax controversy matter we achieved a 98% reduction in an income tax liability position from the original Position Paper through assessment, objection and subsequent appeal. This matter involved managing an aggressive audit, an insistent debt recovery and the issue and agreement for the withdrawal of garnishee notices.

Working with the ATO and within guidelines we negotiated an innovative tax liability write off for our client who thereby managed to avoid bankruptcy, saving in excess of $5.5 million and avoiding exposure of a profile media individual.

A family’s AUD$60m annual turnover business was threatened when their leased premises was to be compulsorily resumed by the State. At the same time the brothers were negotiating the tax effective succession-exit of their uncle and aunt who started the family business. In addition to legal advice, we mapped and provided strategic direction to an extremely successful resumption compensation claim and worked on inter-family sensitivity to clear the path to succession.

We assisted a family with significant wealth originally created by the grandfather. Our involvement dated from mid-2000’s. The family wealth has devolved upon our firm’s designed structures for the brothers and the grandson who managed the family business. We also managed the due diligence, sale and later the ATO pre-tax return review, all to a very welcomed success.

We assisted multiple families all involving significant wealth (circa AUD$1,400m) started by the grandfather but extensively enhanced by the next generation. Not only is the basis of the future resting on our designs for the extended family, despite being advised against it, the family supported our business evolution tax views to a successful ATO Private & Binding Ruling result.

Trouble can come in two’s; we assisted an individual in a tax investigation and in the midst of an acrimonious divorce. The other alleged there was a partnership and asserted multiple tax compliance failures attempting to shift the tax focus away from them. A proactive and strategic approach resulted in an optimal outcome from both a tax and family law perspective.
